Rockies Real Estate Tours - Terms and Conditions

 

These Terms and Conditions ("Terms") constitute the contract between you and Rockies Real Estate Tours ("the Tour Operator") when you book a tour with us. Please carefully read and understand these Terms before making your booking. If you are booking on behalf of others, you guarantee that you have the authority to accept and do accept these Terms on their behalf.

1. Booking Contract

1.1 Your booking becomes confirmed, and a contract exists when the Tour Operator or your authorized travel agent issues a written confirmation after receiving the applicable payment. It is your responsibility to review the confirmation for accuracy and report any discrepancies immediately. Names must match passport details.

1.2 To make a booking, you must be at least 18 years old and agree to provide complete and accurate information to the Tour Operator.

2. Booking on Behalf of Others

2.1 When booking for others, you become the designated contact person responsible for all payments, changes, and keeping your party informed.

2.2 You represent and warrant that you have obtained all necessary consents when booking on behalf of others, ensuring the accuracy and completeness of the information provided.

3. Required Medical Information

3.1 You must provide any medical information reasonably requested by the Tour Operator and complete the Medical Form if required.

3.2 If you have pre-existing medical conditions, you must submit a Medical Form signed by a licensed physician before or at the time of final payment.

3.3 The Tour Operator reserves the right to request further medical information for your safety or the safe operation of the tour.

3.4 You must disclose pregnancy at the time of booking. The Tour Operator may refuse to carry women over 24 weeks pregnant and anyone with certain medical conditions if reasonable accommodations cannot be arranged.

3.5 Failure to complete the required Medical Form may result in booking cancellation and applicable fees.

3.6 You are responsible for assessing the suitability of the tour for your unique circumstances, limitations, and medical requirements.

4. Special Requirements

4.1 Any special requirements must be disclosed at the time of booking. The Tour Operator will make reasonable efforts to accommodate them, but this may not always be possible due to the nature of destinations and availability.

4.2 The Tour Operator cannot guarantee accommodation of food allergies or dietary restrictions.

 

5. Age Requirements

5.1 Minors (under 18) must be accompanied by an adult. One adult may accompany up to two minors.

5.2 Bookings with minors are subject to approval by the Tour Operator, and accompanying adults must secure all necessary consents and documentation.

5.3 Adults on a booking with minors are responsible for their behavior, well-being, and supervision.

 

6. Mandatory Insurance Requirements

6.1 Travel insurance with minimum medical, evacuation, and repatriation coverage of CAD$100,000 is mandatory for all tour participants.

6.2 The Tour Operator will verify your insurance coverage on the first day of the tour.

6.3 It is your responsibility to ensure you have adequate insurance coverage.

 

7. Prices, Surcharges, and Taxes

7.1 The Tour Operator will not increase the tour price after full payment is made.

7.2 Tour prices include applicable taxes, and reduced pricing applies only to new bookings.

 

8. Validity

8.1 Tour dates, itineraries, and prices are subject to change, and the current price will be quoted at the time of booking.

8.2 It is your responsibility to stay updated on your tour details.

9. Details Required for Booking

9.1 You must provide requested information along with payment.

9.2 Failure to supply required information may result in booking cancellation and applicable fees.

10. Airfare

10.1 Tour prices do not include airfare.

10.2 Refer to the airline's terms and conditions for airfare information.

 

11. Payment Terms & Acceptance of Booking

11.1 Full payment is due upon booking your tour.

11.2 The Tour Operator is not responsible for fees charged by third parties or financial institutions.

12. Cancellation by the Participant

12.1 Cancellation fees will be determined based on the date of notice and the total price paid.

12.2 Cancellation fees apply to tours, arrival transfers, and pre/post-night accommodations.

12.3 Any cancellation by a Client must be made in writing and be acknowledged by the Company in writing.

The date on which the request to cancel is received by the Company or its Agents will determine the cancellation fees applicable.

12.4 Cancellation for Tours: The cancellation fees are expressed hereafter as a percentage of the total tour price,

excluding insurance:

- Cancellation 60 days or more before departure: A cancellation fee of CAD$200 will be held by the Company.

- Cancellation 59-30 days before departure: 50% of cost of services booked.

- Cancellation less than 30 days before departure: 100% of cost of services booked.

- Custom trips may vary in cancellation policy from that detailed in this clause, and will be detailed at time of booking.

13. Guaranteed Departures & Cancellation by the Tour Operator

13.1 A tour is guaranteed when secured by a valid payment of at least two participants.

13.2 The Tour Operator guarantees that tours depart as indicated, subject to reasonable changes or Force Majeure.

13.3 In the case of Tour Operator cancellation, you may choose a substitute tour, travel credit, or refund, as applicable.

14. Travel Documents

14.1 It is your responsibility to obtain and possess all required documentation, including a valid passport, visas, permits, vaccinations and certificates.

14.2 You are responsible for all costs incurred due to missing or defective documentation.

14.3 The Tour Operator does not provide advice on travel documents and is not liable for any errors or omissions.

15. Flexibility & Unused Services

15.1 Nature of Real Estate Tours: You understand that real estate tours may require flexibility, and you agree to permit reasonable alterations to products, services, or itineraries by the Tour Operator. Changes may occur in response to unforeseeable circumstances or events beyond our control, such as Force Majeure, illness, mechanical breakdown, strikes, political events, etc.

15.2 Missed or Unused Services: No reimbursements, discounts, or refunds will be issued for services missed or unused after departure due to reasons unrelated to the Tour Operator. This includes circumstances where you are removed from the tour due to your negligence or a breach of these terms.

 

16. Changes

16.1 Changes by the Tour Operator: We reserve the right to modify itineraries when reasonably required, in our sole discretion. If a Material Change, as defined below, is made more than 14 days before departure, you have options outlined below.

16.2 Material Change: A "Material Change" refers to changes affecting at least one in three full days of the itinerary or significantly affecting the character of a product or service. In such cases, you may:

  • i) Accept the Material Change and proceed with the amended product or service.

  • ii) Book another product or service of equal or greater value if available (you will be responsible for the price difference).

  • iii) Book another product or service of lesser value if available (with a refund for the price difference).

  • iv) Cancel the amended product or service and receive a full refund for the land-only portion of the applicable product or service.

16.3 Itinerary Changes After Departure: While on tour, changes may be necessary due to unforeseen circumstances, operational concerns, or safety. Such changes are at our discretion, and you are responsible for covering incidental expenses.

16.4 Financial Resources: You are responsible for having reasonable financial resources to cover incidental expenses, whether arising from a change of itinerary or other unforeseen circumstances.

16.5 Indirect and Consequential Losses: The Tour Operator is not liable for any indirect or consequential losses associated with changes to a booking or itinerary.

16.6 Changes Made by You: Any changes you request to your booking are subject to our approval, availability, and these Terms. Any additional costs for making changes will be charged to you, along with an administrative fee.

17. Acceptance of Risk

17.1 Acknowledgment of Risks: You acknowledge that real estate tours and the associated products and services may involve risks to your health and safety. By participating in our tours, you confirm that you have considered these risks and assume responsibility for them.

17.2 Participation Waiver: You must complete a participation waiver ("Waiver") before departing on your tour to confirm your assumption of responsibility for associated risks.

17.3 Personal Risk: The degree and nature of personal risk depend on the products or services booked and the location in which they operate. You accept these risks and expressly assume responsibility for travel under such conditions.

17.4 Legal Compliance: You must strictly comply with all applicable Canadian laws and regulations. Failure to do so may result in termination of your travel arrangements at your expense.

17.5 Property Damage: You are responsible for costs incurred due to property damage, destruction, or theft caused by you while on tour. Report pre-existing damage as soon as possible.

17.6. Safety Measures: You agree to take prudent measures to ensure your safety while on tour, including using safety devices and obeying safety instructions.

17.7 Complaints: Any complaints must be promptly reported to the Tour Operator during the tour. We assume no liability for unresolved complaints made after the tour's completion.

18. Third Party Suppliers

18.1 Arrangements with Third Party Suppliers: The Tour Operator may engage Third Party Suppliers to provide components of your booking. These Third Party Suppliers operate independently.

18.2 Third Party Supplier Liability: The Tour Operator is not responsible for the acts or omissions of Third Party Suppliers. Any services provided by Third Party Suppliers are subject to their terms and conditions, and their liability is limited by applicable laws, tariffs, conditions of carriage, and international agreements.

19. Optional Extras

19.1 Definition: "Optional Extras" are activities, transportation, meals, products, or services not expressly included in the Tour itinerary or price.

19.2 Liability: The Tour Operator's assistance in arranging Optional Extras is at your request, and we disclaim liability for participation in Optional Extras. Liability for loss, damages, or injuries related to Optional Extras rests with the third party providing that service.

20. Liability

20.1 Limitation of Liability: The Tour Operator and its employees, affiliates, officers, directors, and Third Party Suppliers are not liable for:

  • A) Damages, losses, injuries, or deaths caused by other providers.

  • B) Losses due to factors beyond our control, including acts of God, government actions, terrorism, illness, and other Force Majeure events.

20.2 Limit of Liability: In cases involving personal injury, death, or illness, our liability is limited by applicable international conventions. For other claims, our maximum liability is the price you paid for the applicable Tour, excluding insurance premiums and administration charges.

20.3 Double Recovery: You cannot make the same claims against both the Tour Operator and our suppliers, contractors, or third parties.

21. Force Majeure

21.1 Limitation of Liability: We are not liable for any loss or detriment due to Force Majeure events, which include various unforeseen and uncontrollable factors that may disrupt or prevent a tour.

​

22. Images and Marketing

22.1 Consent: You consent to images, photos, or videos taken during the tour. We may use these for marketing purposes without further compensation.

​

23. Privacy Policy

23.1 Personal Information: We collect your personal information as needed to provide our tours and services. Refer to our Privacy Policy for more details, which is incorporated into these Terms.

​

24. Severability

24.1 Enforceability: If any provision of these Terms is overly broad and unenforceable, it will be interpreted as narrowly as necessary to be enforceable. The invalidity or unenforceability of one provision does not affect the others.

​

25. Contract Parties & Successors

25.1 Binding on Parties: These Terms are binding on both parties and their respective representatives, heirs, successors, and assigns.

​

26. Applicable Law

26.1 Governing Law: These Terms are subject to the laws of Alberta, Canada, and any disputes will be resolved

By booking a tour with Rockies Real Estate Tours, you acknowledge that you have read, understand, and agree to these Terms.
